TKO Jersey Co. Inc. makes custom sublimated sports apparel. We are based in Woodstock, Ontario, and we sell to teams, leagues, associations and individuals in Canada and the United States.
This policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it, and what you can ask us to do with it. It applies to our website, our online store, our team stores, and to the phone calls, emails and messages you exchange with us.
We are subject to Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). Where the privacy law of your own province, state or country gives you additional rights, those rights apply too.
By using our website or placing an order with us, you accept the practices described here. If you do not agree with them, please do not use the site, and contact us so we can discuss another way to work together.
1. Personal information we collect
Information you give us directly

Contact details. Your name, email address, phone number, billing address and shipping address.

Team and organization details. The team, club, league, school or association you represent, your role with it, and the contact details of other people you ask us to deal with.

Order details. The products you ask about or buy, sizes, quantities, quotes, invoices, payment records, delivery arrangements, returns and reorders.

Roster and personalization details. The player, coach and staff names, nicknames, numbers, sizes and any other text you ask us to print on garments. This often includes information about children. Section 3 explains how we handle it.

Designs and artwork. Logos, crests, sponsor marks, photographs and other files you send us, along with the design notes and approvals we exchange with you.

Communications. The content of your emails, web forms, phone calls, text messages, social media messages and support conversations, including any attachments.

Reviews and photos. Anything you choose to submit publicly, such as a product review or a photo of your team.

Account details. If you create an account on our store, your login credentials and saved preferences.
Information collected automatically when you use our website
- Your IP address, approximate location, device type, browser, operating system and referring website.
- The pages you visit, the products you view, what you add to your cart, and how you move through the site.
- Information collected through cookies and similar technologies. Section 12 covers this.
Information we receive from others
- Our payment processor confirms whether a payment succeeded and gives us limited card details such as the last four digits and the card type.
- Our shipping carriers give us tracking and delivery information.
- Our advertising and analytics providers give us aggregated information about how people find and use our site.
- Team representatives give us information about the players and staff on their roster.
We do not collect or ask for government identification numbers, health information, or any other sensitive category of personal information beyond what is described above.
2. Why we collect personal information
We use personal information for the following purposes, and not for unrelated purposes without telling you first:
- To prepare quotes, produce design mockups, and answer your questions.
- To take, produce, print, pack and ship your order, and to handle returns, remakes and reorders.
- To process payments and keep the financial and tax records we are required to keep.
- To keep your artwork and previous specifications on file so that reorders are fast and consistent.
- To provide customer support and keep a record of what we discussed with you.
- To send you order updates, proofs, approvals, invoices and delivery notices.
- To send you marketing messages, if you have agreed to receive them.
- To ask you for a review after your order is delivered.
- To understand how our website is used, and to improve it.
- To advertise our products, including online advertising.
- To detect and prevent fraud, and to keep our systems and records secure.
- To meet our legal obligations, respond to lawful requests, and establish or defend legal claims.
3. Roster information and information about children
Our website and our sales process are meant for adults. We do not market to children and we do not knowingly collect personal information directly from a child.
We do, however, print names and numbers on garments for youth teams, so we routinely receive lists that include the names, nicknames, numbers and sizes of children. That information comes to us from the adult who is placing the order, normally a coach, manager, treasurer or parent volunteer.
If you send us a roster, you confirm that you have the authority to give us that information for the purpose of having the garments made.
We use roster information only to produce your order, to keep a record of what was produced, and to make reorders and replacements straightforward. We do not use it for marketing, we do not build profiles from it, and we do not sell it or disclose it to anyone other than the suppliers who need it to make or ship your garments.
If you are the parent or guardian of a child whose information you believe we hold, contact our Privacy Officer using the details in section 13 and we will confirm what we have and delete it where we are able to do so.
4. Consent
In most cases we collect personal information because you have given it to us in order to get a quote or place an order. Your consent is implied by that request.
We ask for your express consent before sending you marketing messages, and before using your photos or your team's name in our own marketing.
You can withdraw your consent at any time by contacting us. Some consequences are worth understanding before you do. If you withdraw consent while an order is in production, we may be unable to complete it. We may also need to keep certain records after you withdraw consent, for example financial records we are required by law to retain.
5. Who we share personal information with
We do not sell your personal information. We share it only in the circumstances below.
Suppliers who help produce and deliver your order
- Our overseas garment manufacturing partner, which receives your designs and the names, numbers and sizes to be printed. See section 6.
- Canadian suppliers who provide embroidery, screen printing, direct to film printing, and promotional items.
- Freight and courier companies, including international air freight carriers and domestic parcel carriers, which receive the delivery information they need.
Service providers who help us run the business
- Shopify, which hosts our store and website and processes orders. See section 8.
- Our payment processor.
- Our customer support inbox provider, which stores our email and social media conversations with you.
- Our production tracking, accounting, file storage and email providers.
- Our review platform, which collects and displays product reviews.
- Our analytics and advertising providers, including Google and Meta.
These providers are permitted to use your personal information only to provide services to us. We put contractual and other measures in place to require them to protect it and to use it for no other purpose.
Other circumstances
- When you ask us to share information with someone else, for example another person on your team.
- Where we are required or permitted by law to disclose information, including in response to a valid legal demand.
- To establish, exercise or defend legal claims.
- If our business is sold, merged or reorganized, in which case your information may transfer to the buyer as part of the business. We will require the buyer to continue to protect it.
6. Personal information processed outside Canada
This is an important disclosure, so we are stating it plainly.
Our garments are manufactured overseas, in Pakistan. To produce your order, we send our manufacturing partner your artwork and the personalization list, meaning the names, nicknames, numbers and sizes to be printed. We do not send billing information, payment details, phone numbers or email addresses.
Some of our other service providers also store or process information outside Canada, including in the United States and elsewhere.
While your personal information is in another country, it is subject to the laws of that country. That means a court, law enforcement agency or regulator in that country may be able to obtain access to it under that country's law, and the protections available to you may differ from those under Canadian law.
We use contractual and other measures to require our overseas suppliers and providers to protect your personal information and to use it only for the purposes we have specified.
7. Team stores and third party ordering platforms
Some orders are placed through a team store set up for a specific club, school or association. Depending on the store, it may run on our own website or on a third party team store platform.
Where a store runs on a third party platform, that platform collects your order and payment information under its own privacy policy, and shares your order details with us so that we can produce and ship your items. This policy governs what we do with the information once we receive it. We recommend reviewing the platform's own policy for what it does with the information it collects.
We share sales summaries with the club or association that the store belongs to. Where those summaries identify individual purchasers, we tell you at the time of ordering.
8. Shopify
Our store and website run on Shopify, which processes personal information about your visit and your order in order to provide and improve the service. Some Shopify features also use information about how people interact with our store and with other merchants that use Shopify. Shopify is responsible for its own handling of that information, including responding to requests you make about it.
Shopify's privacy policy for shoppers is available at https://privacy.shopify.com/en, and depending on where you live you may be able to exercise privacy rights directly with Shopify at that address.
9. Payment information
We do not store complete payment card numbers. Card payments are processed by our payment provider, which is responsible for handling card data securely and to industry standards. We receive only a confirmation of payment and limited details such as the card type and its last four digits.
For customers who pay by e-transfer, cheque or bank transfer, we receive and retain the payment records associated with that method.
10. How long we keep personal information
We keep personal information only as long as we need it, then delete it or make it anonymous.

Order, invoice and payment records: at least seven years after the end of the tax year in which the order was placed, to meet Canadian tax and accounting requirements.

Designs and artwork: indefinitely, unless you ask us to delete them. Teams commonly reorder years later, and keeping the files means we can reproduce your garments exactly rather than starting over. If you would rather we delete your artwork, tell us and we will.

Roster and personalization lists: as long as we keep the related order record, so that we can produce replacements and reorders.

Support conversations: normally three years.

Marketing contact details: until you unsubscribe or ask us to remove you, plus a short period afterwards so that we can honour your request.

Website analytics information: as set by our analytics providers, normally no more than 26 months.
11. How we protect personal information, and what happens if something goes wrong
We use safeguards appropriate to the sensitivity of the information we hold. These include access controls and multi factor authentication on our business systems, encryption in transit on our website, limiting access to the people who need it to do their jobs, and contractual requirements on our suppliers.
No system is completely secure, and we cannot guarantee that information sent to us over the internet will be secure in transit. Please do not send us sensitive information through unsecured channels.
If a breach of our safeguards creates a real risk of significant harm to you, we will report it to the Office of the Privacy Commissioner of Canada and notify you as required by law.
12. Cookies, analytics and advertising
Our website uses cookies and similar technologies to keep your cart working, remember your preferences, measure how the site is used, and support advertising.
We use Google and Meta products for analytics and advertising. These allow us to measure the performance of our advertising and to show our ads to people who have visited our site.
You can control cookies through your browser settings, and you can opt out of personalized advertising through the privacy settings on our website and through the ad settings offered by Google and Meta. If your browser sends a Global Privacy Control signal, we treat it as an opt out request for that browser. We do not respond to other "do not track" signals.
Blocking some cookies may stop parts of the site from working properly.
13. Your rights
You can ask us to:

Tell you what we hold. We will confirm whether we hold personal information about you, what it is, how we have used it, and who we have shared it with.

Give you a copy. We will provide it in a usable format.

Correct it. If something is wrong or incomplete, we will fix it and, where appropriate, tell anyone we shared it with.

Delete it. We will delete what we are able to delete, and explain anything we must keep and why.

Stop marketing to you. Unsubscribe using the link in any marketing email, or just tell us.

Withdraw your consent. See section 4.
To make a request, contact our Privacy Officer using the details below. We may need to verify who you are before we act, and we will not ask for more information than we need to do that. We will respond within 30 days. If we need longer, we will tell you why and when to expect an answer. We will not treat you differently for making a request.
If you live somewhere that gives you additional rights, such as Quebec, the European Union, the United Kingdom, or a US state with a consumer privacy law, tell us where you are located when you contact us and we will apply the rights available to you there.

Please contact us first if you have a concern. We would rather hear about it and fix it.
If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner of Canada at www.priv.gc.ca or 1-800-282-1376. If you live in Quebec, you can complain to the Commission d'accès à l'information du Québec. If you live outside Canada, you may also be able to complain to the privacy regulator where you live.

Our site links to websites we do not control, including social media platforms and our team store platform. We are not responsible for their privacy practices. Please review their policies before giving them your information.
16. Changes to this policy
We may update this policy as our business, our systems or the law change. We will post the updated version here and change the "Last updated" date. If a change is significant, we will tell you directly or post a notice on our site.
